Categories of Personal Data Processed by Navionics

Personal data that is processed when you create a Navionics account:

When you create a Navionics account, we ask you to provide your email address and name. You can choose to provide only your first name or a nickname instead of your full name if you wish.

PURPOSES AND LEGAL GROUNDS:

(a) Navionics processes your email address because you use your email address and your password to sign in to your account. The legal ground for processing your email address for this purpose is based on Navionics’ legitimate interest in protecting the security of your account.

(b) Navionics also processes your email address or other account information for the purpose of sending you important information via e-mail, in-app message, or other means about your Navionics products, apps or account, such as important safety information or material changes to this Privacy Policy. The name you provide is associated with your account profile and is displayed when you submit comments. The legal ground for processing your email address, name, or other account information for these purposes is Navionics’ legitimate interest in providing you important safety or other information about your Navionics products, apps or account or material changes to this Privacy Policy, and in providing you an opportunity to engage with other Navionics users.

(c) If you provide your opt-in consent to receiving marketing information from Navionics, Navionics will also process your email address or other account identifiers for the purpose of sending you marketing communications (e.g., emails, push notifications) about Navionics products and apps. The legal ground for processing your email address for this purpose is your consent. You may withdraw your consent at any time by changing your preferences in your Navionics account or through the unsubscribe link at the bottom of our marketing emails. The marketing communications you receive from Navionics are based on the preferences you provide in your Navionics account, the locale indicated by your IP address, the types of Navionics products you have added to your Navionics account, and any subscriptions included in your Navionics account. The legal ground for processing this data for this purpose is Navionics’ legitimate interest in ensuring marketing communications are relevant and reducing the number of marketing emails sent to each particular customer by selecting which customers receive a particular marketing communication rather than sending every marketing communication to every customer who has consented to receiving marketing communications.

(d) Navionics also processes your email address to associate it with your Navionics account when you interact with our customer support representatives. The legal ground for this processing is our legitimate interest in providing quality customer support.

(e) Navionics also processes your email address to notify customers when they have violated the terms of use. The legal ground for this processing is our legitimate interest in ensuring a quality experience for all customers and ensuring adherence to the terms of use.

Personal data that is processed when you communicate with Navionics:

When you interact with our customer support representatives via email, telephone, online or in person, we collect personal data, such as your name, mailing address, phone number, email address and contact preferences; and information about the Navionics products you own, such as their serial numbers and date of purchase. We also may create event logs that are useful in diagnosing product or app performance-related issues, and capture information relating to the support or service issue. To improve customer service, subject to applicable laws, we may also record and review conversations with customer support representatives, and analyze any feedback provided to us through voluntary customer surveys. With your consent, our customer support representatives may sign in to your Navionics account, if appropriate, to help troubleshoot and resolve your issue.

PURPOSE AND LEGAL GROUND:
We use this information to provide you with customer and product support and to monitor the quality and types of customer and product support we provide to our customers. The legal ground for processing this information for these purposes is Navionics’ legitimate interests in providing quality product support. The legal ground for signing in to your Navionics account, if appropriate, to help troubleshoot and resolve your issue is consent, which you may withdraw at any time.

Personal data that is processed when you submit Community Edits:

When you add reviews or comments to markers and choose to attach your nickname, which you may select or modify, to your contributions, we process your nickname to identify the author of the review or comment. The reviews or comments may be submitted anonymously if desired.

PURPOSE AND LEGAL GROUND:
The legal ground for processing this information for this purpose is your consent. You may revoke your consent at any time by deleting the review or comment or by deleting your Navionics account. Current versions of the app allow you to disable Community Edits; however, if you are using an older version, you may send an email to privacy@navionics.it to disable Community Edits.

Personal data that is processed when you purchase a product or subscription through the website, apps, or customer support:

When you purchase products or subscriptions on the Navionics website or through our apps or customer support, we collect your name, address, telephone number, and email address.  We do not view or store your payment card information.  A third party, Braintree, a PayPal company, processes customer payment information when customers make a purchase on a Navionics website or app or through customer support.  PayPal and PayPal Express process customer payment information when customers make a purchase through Chart Installer.  We recommend you carefully review PayPal's Privacy Policy.  If you purchased a physical product, such as a cartographic data card, we use couriers to deliver the purchased product.

PURPOSE AND LEGAL GROUND:
We collect your name, address, and telephone number, and email address so we can process your order, fulfill your purchase, and send you invoices or updates on your order(s).  The legal ground for processing your name, address, email address, and telephone number for these purposes is performance of a contract. We also process your personal data as part of our fraud detection processes. The legal ground for processing your personal data for that purpose is our legitimate interest in protecting Navionics and our customers from attempts to engage in fraudulent transactions.  We also process your email address or other account identifier to communicate with you about your subscription, including expiration notices or other important information about the services.  The legal ground for processing your personal data for that purpose is our legitimate interest in sending you important information pertinent to your subscription.

Personal data that is processed when you use our products, apps, or website:

When you use our products, app, services, or website, we collect personal data such as your IP address, GPS location, tracks, waypoints, usage information, or other information from your plotter or mobile device in connection with the use of such products, app, services, or website. 

PURPOSE AND LEGAL GROUND:
(a) This information is processed to provide you with the requested services.  The legal ground for processing this information for this purpose is performance of a contract.

(b) If you give your consent, tracks and waypoints are processed to sync your data to your account and to any other devices you use.  The legal ground for processing this information for this purpose is your consent, which you may withdraw at any time by turning this feature off in the app. 

(c) This usage data, including tracks and waypoints, are also processed in an aggregated, anonymized manner for improvement of our products and services.  The legal ground for processing this information for this purpose is our legitimate interest in providing you with quality products and services.

Personal data that is processed when you are a WebAPI or SDK partner:

When you sign up as a WebAPI or SDK partner, we collect contact details, such as your name, email address, company name, and mailing address.

PURPOSE AND LEGAL GROUND:
This information is processed to manage access to our API and SDK as well as to communicate with you about these programs.  The legal ground for processing this information for these purposes is performance of a contract.

Personal data that is processed when you attend a Navionics webinar:

When you sign up for or attend a Navionics webinar, we collect contact details, such as your name and email address.

PURPOSE AND LEGAL GROUND:
This information is processed to provide you access to the desired webinar.  The legal ground for processing this information for these purposes is your consent, which you may withdraw at any time by contacting customer care.

Categories of Recipients of Personal Data

Other Navionics users:
If you make use of the Community Edits function to interact with other users, your comments and other submitted information will be visible to other Navionics users.  Your name or nickname will be visible and associated with these comments and information only if you have chosen to do so.

Other service providers:
Navionics uses cloud services from third parties such as Adobe, Emarsys, and MailChimp to assist in sending emails. Those services track the activities associated with these emails, such as whether they were opened, whether links in the emails were clicked on, and whether purchases were made following clicks on those links. Navionics uses this data to analyze the level of engagement with its emails. We encourage you to carefully review MailChimp's Privacy Policy.

Navionics uses cloud services from third parties such as Amazon Web Services (AWS) and Microsoft for webhosting and storage of data. Navionics uses cloud services from third parties such as Salesforce and Atlassian to manage customer interactions and associated tasks or troubleshooting.  Navionics uses cloud services from third parties such as Magento and SAP to provide the ecommerce portion of the website and enable online purchases of products and services.  Navionics uses a third party, GoToMeeting, to provide the web conferencing platform for webinars.  With your consent, Navionics uses another third party, TeamViewer, to facilitate customer support troubleshooting.

Navionics uses third party advertising platforms to market to users, such as Microsoft Advertising and Google Ads.  We encourage you to carefully review Microsoft's Provacy Policy and Google's Privacy Policy.

Other disclosures:
We may disclose personal data about you to others: (a) if we have your valid consent to do so; (b) to comply with a valid subpoena, legal order, court order, legal process, or other legal obligation; (c) to enforce any of our terms and conditions or policies; or (d) as necessary to pursue available legal remedies or defend legal claims.

We may also transfer your personal data to an affiliate, a subsidiary or a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of Navionics’ or Garmin’s business, assets or stock, including, without limitation, in connection with any bankruptcy or similar proceeding, provided that any such entity that we transfer personal data will not be permitted to process your personal data other than as described in this Privacy Policy without providing you notice and, if required by applicable laws, obtaining your consent.

Transfers of Personal Data

Navionics and Garmin are global businesses. To offer our products, apps and services, we may need to transfer your personal data to other Garmin companies in other countries. In particular, Garmin International, Inc. and Garmin (Europe) Ltd. act as processors on behalf of Navionics to help provide infrastructure, security, and other services to our customers. Where your data is transferred to an entity that is not in the EU or a jurisdiction deemed adequate by the European Commission, Navionics has entered into model contractual clauses approved by the European Commission.

Garmin International, Inc., Garmin Services, Inc., and Garmin AT, Inc. are subject to the oversight of the U.S. Federal Trade Commission and remain responsible for personal data transferred to third parties that process it on our behalf. Cookies and Similar Technologies

To help analyze how you and other visitors navigate Navionics’ website, compile aggregate statistics about site usage and response rates, help diagnose any problems with Navionics’ servers and administer Navionics websites, we, with assistance from third-party analytics service providers, collect certain information when you visit our site. This information includes IP address, geographic location of the device, browser type, browser language, date and time of your request, time(s) of your visit(s), page views and page elements (e.g., links) that you click. We may use cookies, pixel tags, web beacons, clear GIFs or other similar tools on our site or in our email messages to assist us in collecting and analyzing such information. We use this information to provide better, more relevant content on our site or in advertisements (including those on third party websites or social media), to identify and fix problems, and to improve and customize your overall experience on our site.

Apps:
We also collect data from users about their usage of our apps, including ChartInstaller. The types of analytical information that are collected include the date and time the application accesses our servers, software version, the location of the device, language setting, what information and files have been downloaded to the app, user behavior (e.g. features used, frequency of use), device state information, device model and brand, hardware and operating system information, and information relating to how the app functions. Navionics uses this data to improve the quality and functionality of the applications; to develop and market products and features that best serve you and other users; and to help identify and fix app stability issues and other usability problems as quickly as possible.

The legal ground for processing this analytical information is our legitimate interest in understanding how our customers interact with our products, apps, and websites so we can enhance the user experience and functionality of our products, apps, and websites.

Here are examples of third-party providers of analytics and similar services we currently use:

ANALYTICS SERVICES:

  • Google: Google Analytics and Google Data Studio is used to track site statistics and user demographics, interests and behavior on websites. We also use Google Search Console to help understand how our website visitors find our website and to improve our search engine optimization.   • HockeyApp; Crashlytics (Fabric); Firebase: HockeyApp, a Microsoft service, and Crashlytics and Firebase, which are Google services, are used to help us better understand usage of Navionics apps to improve user experience and to identify and resolve the root causes of app crashes.
  • Hotjar: This website uses Hotjar web analytics. Hotjar helps us measure and evaluate site usage behavior, such as mouse clicks, mouse movements, keystrokes (excluding personally identifiable information), scrolling activity, and pages visited and actions taken on the site. For more information, view the Hotjar privacy policy. You can opt out of having Hotjar track your site usage behavior.

SOCIAL NETWORKS:

Third-party social networks (such as Facebook) that provide interactive plug-ins or other common social networking features (e.g., to allow you to “Like” a page) on Navionics websites or mobile apps may use cookies or similar technologies to gather information regarding your use of our website and apps.  We encourage you to carefully review the privacy policy for the particular social network’s websites.  We may also receive aggregated analytics information from these social networks that help us measure the effectiveness of our activities and advertisements. 

TAG MANAGEMENT:
Navionics uses Google Tag Manager to help manage the various analytics services and cookie and pixel tag technologies Navionics uses to measure website usage. To provide such services, Google receives basic server log information from users of Navionics’ websites (e.g., IP address, browser and operating system information).

Privacy Policy Updates

We may update this Privacy Policy from time to time as we add new products, features, or apps, as we improve our current offerings and as technologies and laws change. You can determine when this Privacy Policy was last revised by referring to the “Last updated” legend at the top of this page. Any changes will become effective upon our posting of the revised Privacy Policy.

We will provide notice to you if these changes are material and, where required by applicable law, we will obtain your consent. This notice will be provided by email or by posting notice of the changes on the Navionics websites and apps that link to this Privacy Policy.

Retention of Personal Data

We will retain your personal data as long as your Navionics account is considered to be active or as long as required by applicable law. In addition, see below under “Your Rights” for a description of your right of erasure.
